Court directs SMC, police to enforce Soura road order

Srinagar, Dec 25: A local court has directed the Srinagar Municipal Corporation (SMC) and the Police to ensure compliance of an earlier court order restraining authorities from obstructing the access road leading to the residence of a Soura resident.

The order was passed by the Court of Ist Civil Subordinate Judge/Municipal Magistrate Srinagar while hearing an application filed by Farooq Ahmad Lone, of Soura, seeking implementation of an order dated June 9, 2023.

The applicant had approached the court, alleging that despite clear judicial directions, officials of SKIMS and other concerned authorities had wilfully violated the restraint order by dumping construction material and blocking the gate and approach road leading to his house.

According to the plaintiff, the court had earlier restrained the concerned SKIMS authorities from closing the gate leading to the applicant’s house except by adopting due process of law. However, it was alleged that despite having full knowledge of the order, the non-applicants blocked the access road on multiple occasions in November and December 2025, causing serious hardship and affecting the applicant’s right of ingress and egress.

After hearing the counsel for the applicant and perusing the record, the court observed that preservation of the suit property was necessary, failing which the applicant’s suit would become infructuous.

The court directed the Ward Officer concerned of the Srinagar Municipal Corporation and the Station House Officer of the concerned police station to visit the spot, verify whether there has been any violation of the court’s order dated June 9, 2023, and if found correct, implement the order in its true letter and spirit. The authorities have also been directed to file a compliance report before the court—(KNO)
