Srinagar, Sep 21: The Jammu and Kashmir government has dismissed a Teacher Grade-II from service, citing a case registered against him under various provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, and the Protection of Children from Sexual Offences (POCSO) Act, 2012.
According to a government order, a copy of which was accessed by the news agency—Kashmir News Observer (KNO), the Government said it was satisfied, after considering the facts and circumstances of the case, including the registration of FIR under Sections 61(2), 65(1), 90, 91 and 92 of the BNS, 2023, and Sections 4, 6, 8, 10 and 17 of the POCSO Act, 2012, that the activities of the Teacher Grade-II at Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, District Kishtwar, warranted the imposition of a major penalty.
The order said the case of the teacher, who was under suspension, was placed before the competent authority, which, after due consideration of all facts and circumstances, decided to impose the major penalty of dismissal from service, which ordinarily disqualifies him from future employment.
The Government said the penalty was imposed under sub-clause (b) of the proviso to clause (2) of Article 311 of the Constitution of India read with Rule 30 (viii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, considering that it was not reasonably practicable to hold an enquiry in the case and that his continued employment would be detrimental to the interests of the Government and erode public trust in Government institutions.
The order further stated that, in exercise of the powers under the provisions, the Government imposed the major penalty of dismissal from service, with disqualification from any future employment in Government service of the UT of J&K, upon Khalid Hussain, Teacher Grade-II, presently posted at Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, District Kishtwar. The order identified him as the son of Ghulam Mohd and a resident of Gurinalla, Chatroo, District Kishtwar. (KNO)
